No fine-print surprises. Here's everything that governs your Kauai rental — requirements, deposits, coverage, responsibility, permitted use, cancellations, our terms of service, and how we handle your data.

Rental Requirements & Eligibility
To rent a vehicle from Rent-A-Wreck Kauai, the renter and every additional driver must meet the following minimum requirements. All requirements are verified at the time of pickup, and we reserve the right to refuse or cancel a rental if they are not met.
Driver requirements
- A valid, unexpired driver's license held by the renter and each additional driver, presented in person at pickup.
- Renters and all drivers must be at least 21 years of age. Drivers between 21 and 24 may be subject to a young driver surcharge and certain vehicle-class restrictions.
- A valid major credit card (or accepted debit card) in the renter's name with sufficient available funds for the estimated charges plus a security authorization.
- Government-issued photo identification in addition to the driver's license may be requested.
International & out-of-state renters
Visitors from outside the United States must present a valid driver's license from their country of residence. A license printed in a non-Roman alphabet must be accompanied by a valid International Driving Permit. Out-of-state U.S. licenses are accepted.
Right to refuse
We reserve the right, in our sole discretion and to the extent permitted by law, to decline to rent to any person who does not meet our requirements, who provides inaccurate information, or whose rental we reasonably believe may result in loss or liability.
Reservations, Rates, Taxes & Fees
Reservations
A reservation confirms a vehicle class — not a specific make or model — for the dates and location requested, subject to availability. Vehicle images on this site are representative; the actual vehicle assigned is based on class and on-hand availability at pickup.
Rates
Quoted rates apply only to the dates, vehicle class, location, and options selected at the time of booking. Rates are subject to change until a reservation is confirmed. Daily rates are based on a 24-hour rental day; a grace period may apply, after which additional time may be charged at the applicable hourly or daily rate.
Taxes, surcharges & fees
Rentals are subject to applicable taxes, government surcharges, and fees, which may include state and county general excise and surcharge taxes, vehicle license/registration recovery fees, airport concession recovery fees, and optional product charges. Estimated taxes and fees are disclosed during booking; final amounts are calculated on your rental agreement.
Payment, Deposits & Security Holds
At pickup we place an authorization hold on your card for the estimated rental charges plus a refundable security deposit. This hold reduces your available balance or credit limit until the rental is closed and your bank releases it, which can take several business days after return. The hold amount varies by vehicle class and rental length.
Accepted payment methods
- Major credit cards in the renter's name are accepted for the deposit and final charges.
- Debit/check cards may be accepted subject to additional verification and a larger authorization hold; prepaid, gift, and cash-loaded cards are generally not accepted for the security deposit.
- The card presented at pickup must belong to the renter named on the agreement.
You authorize us to charge the payment method on file for all amounts due under the rental agreement, including rental charges, optional products, fuel, tolls, fines, taxes, fees, and any loss, damage, or related costs that become payable, whether assessed during or after the rental.
Insurance, Protection & Coverage Options
Coverage is optional and is never added by default. You choose what is right for you at booking, and you may decline all optional protection and rely on your own coverage. The descriptions below are summaries only; the actual terms, conditions, exclusions, and limits are set out in your rental agreement and any applicable protection-product documents.
Optional protection products
- Loss Damage Waiver (LDW/CDW): if accepted and you comply with the rental agreement, we waive or reduce your responsibility for loss of or damage to the rental vehicle, subject to stated exclusions. LDW is not insurance.
- Supplemental Liability Protection: may provide protection above the minimum financial-responsibility limits for third-party bodily injury and property damage claims, subject to the policy terms.
- Personal Accident and Personal Effects coverage: may provide accidental medical and personal-property benefits for you and your passengers, subject to the policy terms.
Using your own insurance
Many guests are already covered by their personal auto insurance or by a benefit on the credit card used to pay for the rental. You are welcome to decline our optional products and use your own coverage. Before you travel, confirm with your insurer or card issuer that your coverage extends to rental vehicles in Hawaii and what deductibles or limits apply.
If you decline all coverage
If you decline all optional protection, you accept full financial responsibility for any loss of or damage to the vehicle and for any liability arising from the rental, to the fullest extent permitted by law and as described in the Renter Responsibility section below.
Renter Responsibility for Damage, Loss & Theft
Unless a valid Loss Damage Waiver has been accepted and the rental agreement has been complied with, the renter and all authorized drivers are jointly and severally responsible for all loss of or damage to the vehicle, regardless of fault.
What you may be responsible for
- The cost of repair or, in the case of a total loss or theft, the fair market value of the vehicle.
- Loss of use (the revenue lost while the vehicle is out of service), measured by our reasonable fleet utilization, whether or not we have other vehicles available.
- Diminished value, towing, storage, impound, and recovery costs.
- A reasonable administrative/claims-handling fee and any appraisal or salvage costs permitted by law.
Accidents, vandalism & theft
You must protect the vehicle, lock it when unattended, safeguard the keys, and promptly report any accident, theft, or vandalism to us and to the police. Failure to report, leaving the keys in an unattended vehicle, or other violations of the rental agreement may void any protection product you purchased and leave you fully responsible.
Authorized Drivers
Only the renter and additional drivers who are listed on the rental agreement and who meet all rental requirements may operate the vehicle. Every additional driver must appear in person at pickup with a valid license. An additional-driver fee may apply.
Allowing an unauthorized person to drive the vehicle is a serious violation of the rental agreement. Any loss, damage, or liability that occurs while an unauthorized driver is operating the vehicle is the renter's full responsibility and may void all protection products, to the extent permitted by law.
Permitted Use & Prohibited Conduct
The vehicle must be used only in a careful, lawful manner and only as permitted by the rental agreement. The following uses are strictly prohibited and will void protection products and may result in full liability for any resulting loss or damage:
- Operating the vehicle while under the influence of alcohol, drugs, or any impairing substance.
- Using the vehicle for any illegal purpose, to commit a crime, or to carry illegal or hazardous materials.
- Driving off paved or officially maintained roads, including 4x4-only and sand tracks such as the road to Polihale, or otherwise where the vehicle is not designed to go.
- Racing, speed testing, driving instruction, pushing or towing another vehicle, or carrying passengers or property for hire (e.g., rideshare or delivery) unless expressly authorized in writing.
- Transporting more passengers or cargo than the vehicle is rated for, or transporting persons or property in violation of law.
- Smoking or vaping in the vehicle, or transporting unsecured pets, which may result in a cleaning fee.
- Taking the vehicle off the island of Kauai by ferry, barge, or any other means.
Geographic limits
The vehicle is rented for use on the island of Kauai. Inter-island transport of the vehicle is not permitted. Driving on roads or areas excluded by the rental agreement is at the renter's sole risk.
Fuel & Mileage
Vehicles are provided with a set fuel level and should be returned at the same level to avoid a refueling charge at our then-current per-gallon rate plus a refueling service fee. A prepaid fuel option may be available at pickup, allowing you to return the vehicle at any fuel level without an additional refueling service charge; prepaid fuel is not refundable for unused fuel.
Reasonable mileage for exploring the island is included with your rental. Vehicles are intended only for Kauai's paved and officially maintained public roads.
Tolls, Tickets, Citations & Other Charges
You are responsible for all parking tickets, traffic and red-light camera citations, toll charges, and similar penalties incurred during your rental, together with any related fines, penalties, court costs, and a reasonable administrative processing fee for each item we are required to handle.
You authorize us to release renter information to toll authorities, law-enforcement agencies, and courts as required, and to charge the payment method on file for these amounts when they are assessed, including after the rental has ended.
Cancellations, Changes & No-Shows
Pay-later reservations
Standard (pay-at-pickup) reservations may be modified or cancelled before the scheduled pickup at no charge. Please contact us as early as possible so we can release the vehicle for other guests.
Prepaid reservations
Prepaid, discounted reservations are non-refundable, as disclosed at the time of booking. Changes to a prepaid reservation are subject to availability and any rate difference, and amounts already paid are not refundable.
No-shows & late pickup
If you do not pick up the vehicle within a reasonable time after the scheduled pickup without contacting us, the reservation may be treated as a no-show and the vehicle released. Prepaid amounts are not refunded for no-shows.
Vehicle Return Condition
Please return the vehicle to the agreed location, on the agreed date and time, in the same condition you received it, ordinary wear excepted. Late returns may be charged additional time at the applicable rate, and may incur additional fees.
Charges may apply for returning the vehicle excessively dirty, for smoking or pet odor requiring detailing, for missing equipment or accessories, or for any unreported damage discovered on return. We will document the vehicle's condition at pickup and return.
Roadside Assistance & Mechanical Issues
If you experience a breakdown, warning light, flat tire, or any mechanical issue, stop driving when it is safe to do so and contact us immediately at (808) 245-7177. Do not attempt repairs or authorize service without our prior approval; unauthorized repairs are not reimbursable.
In the event of an accident, ensure everyone's safety first, call emergency services if anyone is injured, notify the police, exchange information with any other parties, document the scene, and report the incident to us as soon as possible. Roadside service arising from a violation of the rental agreement (such as lockouts, lost keys, running out of fuel, or off-road use) may be billable to the renter.
Disclaimers, Limitation of Liability & Indemnification
Disclaimer of warranties
Except as expressly required by law, the vehicle and all services are provided on an "as is" and "as available" basis, and Rent-A-Wreck Kauai disclaims all warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Rent-A-Wreck Kauai and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or personal property, arising out of or relating to the rental, the vehicle, this website, or these policies, even if advised of the possibility of such damages. We are not responsible for personal belongings left in a vehicle.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Rent-A-Wreck Kauai and its owners, employees, and agents from and against any claims, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the vehicle, your breach of the rental agreement or these policies, or your violation of any law or the rights of any third party.
Rental Agreement
At pickup you will sign a rental agreement that, together with these policies and any protection-product documents, forms the entire contract between you and Rent-A-Wreck Kauai. The rental agreement covers authorized drivers, permitted use, rates and charges, fuel and mileage, the vehicle's condition, your responsibilities, and the terms of any optional products you select.
The signed rental agreement controls in the event of any conflict with information on this website. These policies are a summary for your convenience and are not a substitute for the rental agreement. Terms are subject to change, and the version in effect at the time of your rental applies.
Website Terms of Service
By accessing or using this website and by making a reservation, you agree to these Terms of Service. You agree to provide accurate, current, and complete information and to be responsible for activity under your booking. Rates, availability, vehicle classes, and content are subject to change without notice and are confirmed only at the time of booking.
Acceptable use & intellectual property
You may use this site only for lawful purposes and may not attempt to disrupt it, access it by automated means without permission, or use it to infringe any rights. All content, trademarks, logos, text, and images on this site are owned by Rent-A-Wreck Kauai or its licensors and may not be copied or used without permission.
Governing law & disputes
These Terms, the rental agreement, and any dispute arising out of them or your use of this site are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Hawaii, and you consent to their jurisdiction. If any provision is found unenforceable, the remaining provisions remain in full force.
SMS / Text Message Terms & Conditions
Rent-A-Wreck Kauai offers text messaging (SMS) to keep you informed about your reservation. These terms describe our messaging program and supplement our Privacy Policy below.
Program description
Rent-A-Wreck Kauai sends reservation and customer-care text messages, including booking confirmations, pickup and return reminders, changes to your reservation, payment and receipt notifications, and replies to your customer-service inquiries. Messages relate to your rental and your requests — this is not a promotional marketing list.
Opt-in & consent
- You opt in to receive text messages by checking the SMS consent box during the online reservation process (in the driver-information step, where you provide your phone number), or by providing consent in person, in writing, or during the reservation process at our rental counter.
- Consent to receive text messages is not a condition of renting a vehicle or of any purchase.
- Message frequency varies based on your reservation activity.
- Message and data rates may apply. Contact your mobile carrier for details about your messaging plan.
Opt-out & help
- You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send one final message to confirm that you have been unsubscribed, and you will no longer receive SMS messages from us. To rejoin, opt in again as you did the first time.

Carriers & privacy
- Wireless carriers are not liable for delayed or undelivered messages.
- Your phone number and opt-in consent are used only to send the messages described above. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be sold or shared with any third party.

Information we collect

You can choose not to provide certain information, but you may then be unable to use some features or complete a rental.
- Cookies and similar technologies: Like many websites, we use cookies and similar technologies to recognize you, remember your preferences, secure your session, and improve your experience. You can disable cookies through your browser settings, though some features may not function properly as a result.
- Automatically collected information: Every device has an IP address, and we automatically log IP addresses, browser type, operating system, device identifiers, referring and exit pages, and dates/times of access for security, analytics, and fraud-prevention purposes.
- Vehicle and rental information: Vehicles may be equipped with telematics, GPS, or event-recording systems. Where used and permitted by law, we may collect location, operating, and diagnostic data in connection with the rental, theft recovery, safety, or maintenance.
How we use your information
- To respond to your requests, process and manage your reservation and rental, verify eligibility, and provide customer service.

- Special offers: We may send you offers and updates unless you opt out. If we present offers from other businesses, they come directly through us — we do not share your personal information with them for that purpose.
How we share your information
